It is not a Class 3 E-Bike when it doesn't have a throttle.
It is a Class 1 E-Bike.
Edit:
Class 1 is pedal assist only up to 20 mph.
Class 2 is pedal assist and throttle up to 20 mph.
Class 3 is also pedal assist and throttle up to 28 mph.
However, throttle only is limited to 20 mph.
